Summary: In re Matthew A. LeFande. Bar No. 475995. March 4, 2024. The Board on Professional Responsibility found that LeFande committed multiple violations of the D.C. and Maryland Rules of Professional Conduct in two client matters. In the first matter, LeFande represented two clients who refused to return a large sum of money they mistakenly received during a real estate transaction. Over the course of six years, LeFande made numerous frivolous and improper filings in the matter and was ultimately found guilty of criminal contempt for refusing a court order to take the stand for a deposition. In the second matter, LeFande made multiple frivolous filings and arguments in a bankruptcy proceeding. The Board found that LeFande’s conduct violated D.C. Rules of Professional Conduct 3.1, 3.4(c), and 8.4(d), and Maryland Rules 19-303.1, 19-303.3(a)(1), 19-308.4(c), and 19-308.4(d). Four members of the Board recommended that LeFande be disbarred as a sanction for the misconduct; four others recommended that he be suspended for three years with reinstatement conditioned on a showing of fitness.
